Tampa Roots – Terms & Conditions

By hiring Tampa Roots (“we,” “our,” or “us”) for services, you (“client” or “you”) agree to the terms below. These terms apply to one-time services, recurring care plans, and all communication or agreements related to our work.
1. Scope of Services
Tampa Roots is a sole proprietorship providing landscape design, planting, seasonal refreshes, garden cleanups, and maintenance services. We do not perform licensed work such as irrigation installation, electrical, structural hardscaping, or drainage systems. Our services are non-licensed and cosmetic in nature.
2. Estimates & Payment
Quotes are based on the information you provide and are subject to change if site conditions differ. Final pricing will be discussed and agreed upon prior to starting work. Payment for one-time services is due in full upon completion unless otherwise agreed in writing. Subscription services are billed in advance.
3. Maintenance Plans
We offer weekly, biweekly, and monthly care plans that may include weeding, pruning, deadheading, light cleanup, and garden care. The specific scope will be outlined at the start of service. Maintenance plans are billed before each cycle. To cancel or pause service, we require at least 7 days' written notice. Missed visits due to weather will be rescheduled based on availability. We are not responsible for the health of plants between visits or for damage caused by drought, pests, irrigation issues, or external conditions.
4. Cancellations & Rescheduling
We ask for at least 48 hours’ notice to cancel or reschedule. Cancellations with less than 48 hours’ notice may be subject to a $50 fee. We reserve the right to delay or reschedule due to weather or safety concerns.
5. Site Access & Conditions
You agree to provide safe, unobstructed access to the property on scheduled service days. Locked gates, pets, or hazards may result in rescheduling or additional charges. Work areas must be free of pet waste or dangerous debris.
6. Plant Health Disclaimer
We use Florida-friendly plants suited to your location, light exposure, and soil. However, we cannot guarantee plant survival once installed. Aftercare, including watering and pest control, is the client’s responsibility unless otherwise agreed in writing.
7. No Insurance or Bonding
Tampa Roots is not insured or bonded. By hiring us, you acknowledge and accept all risk related to services performed and waive the right to hold us liable for property damage, personal injury, or loss. This includes, but is not limited to, damage to underground irrigation, utilities, landscape lighting, or plant failure.
8. Liability & Indemnification
You agree to indemnify and hold harmless Tampa Roots from any claims, costs, damages, or losses that arise from or relate to our services. This includes third-party claims, accidental damage, or any harm caused by pre-existing property conditions.
9. No Warranty
Unless expressly stated in writing, no warranties or performance guarantees are provided. All services are offered “as is.”
10. Photos & Marketing
We may take photos of your landscape before and after service for use in our portfolio, social media, or website. No identifying personal information will be shared. You may opt out by requesting this in writing prior to service.
11. Right to Refuse Service
We reserve the right to refuse or terminate service at any time for unsafe working conditions, inappropriate behavior, non-payment, or violation of these terms.
12. Dispute Resolution & Jurisdiction
We encourage open communication. If you have a concern, notify us within 7 days of service so we can address it promptly.
If a dispute arises that cannot be resolved informally, both parties agree to resolve the matter exclusively through small claims court in Pasco County, Florida. Each party is responsible for their own legal costs. You waive the right to pursue class action claims or escalate disputes to higher courts unless required by law.
13. Agreement
By submitting an inquiry, scheduling a service, or otherwise engaging with Tampa Roots, you confirm that you’ve read, understood, and agreed to these Terms & Conditions in full.
